The Edge Rider Policy & Liability Release

MOTORCYCLE RIDING IS VOLUNTARY.
YOU ARE NOT REQUIRED TO RIDE A MOTORCYCLE.
YOU HAVE THE OPTION TO CHOOSE ANY MODE OF TRANSPORTATION YOU MAY PREFER.
The Edge Touring Motorcycle Ride, hereinafter referred to as “The Edge”, is owned and operated by Sports and Entertainment International, hereinafter referred to as “SEI”. The Edge consists of the Primary Motorcycle Riders, hereinafter referred to as the “Edge Riders” and the support Ground Crew, hereinafter referred to as the “Edge Crew” and Participants. The Edge Riders are contracted by SEI to ride motorcycles on The Edge Touring Motorcycle Ride. The Edge Crew consists of individuals contracted by SEI to fulfil the tasks ensuring The Edge is managed and executed at the highest professional level to ensure a safe and smooth operation. The Edge offers individuals the opportunity to take part of and to join The Edge, hereinafter referred to as Participants, by signing up through The Edge website and by selecting and purchasing one of the Rider Experience/Rider Packages that are offered.
Please note, Participants of The Edge are NOT obligated to ride a motorcycle. The Edge, although being presented and promoted as a Touring Motorcycle Ride, allows a Participants the choice of their preferred mode of transportation be it a car, truck, etc.
As presented on The Edge website (www.liveyourliveontheedge.com) the tour schedule outlines all the rides that are planned along with rides that are being developed for a future date. The Edge is available to anyone who chooses to participate by purchasing one or more of the “Rider Packages” associated with each specific ride. When selecting a Rider Package, keep in mind that Rider (motorcycle) and Driver (any other alternate motor vehicle) are interchangeable, and both will hereinafter be referred to collectively as a “Rider”. When selecting a Rider Package, you will also be asked to designate yourself as a Rider – Solo (riding alone) or Rider & Guest (riding with a passenger/guest) The Rider Packages outline in detail what each package contains, your participation, instructions, deadlines, etc. Rider Packages are non-transferable to another individual unless approved by The Edge executive staff.
As a Rider you agree and acknowledge that you possess a valid U.S. State issued driver's license or a valid driver’s license issued to you by another country allowing you to operate a motor vehicle. In the case of a motorcycle, you have the required motorcycle endorsement that allows you to legally operate a motorcycle. You also acknowledge and confirm that you have the required insurance with at least the minimum insurance required by the state you are licensed and your vehicle is registered. You may be required to provide proof of a valid license and insurance coverage prior to or during your participation in The Edge. You also acknowledge and understand that no other or alternate insurance is available to you or coverage provided to you as a Rider of The Edge and the only insurance coverage is provided by you through an insurance company of your choice.
All Participants along with their guest[s] agree with the terms of this Rider Policy and Liability Release when signing up to participate with The Edge. Riders and their Guest[s] must be at least thirteen (13) years of age and any Rider and guest under the age of eighteen (18) years of age must be accompanied by their parent or guardian.
Some of the events planned on The Edge may be prohibited to anyone under 18 years of age and in some cases may prohibit anyone under 21 years of age from attending. Any event that does have an age restriction will be clearly noted giving advance notice to any Rider prior to signing up.
You agree to furnish your own mode of transportation be it a motorcycle or motor vehicle and be familiar with the operation of that chosen mode of transportation. You agree that the motorcycle or motor vehicle is in a safe operational condition. The Edge will not arrange to furnish motorcycles or motor vehicles for any Rider. Riders will be expected to and will at all times operate your motorcycle or motor vehicle in a safe manner and obey all laws. The Edge personnel have the sole and exclusive right to determine if the Rider is operating their motorcycle or motor vehicle is a manner that is unsafe. The Edge personnel will make Riders aware of such fact and outline any special instructions.
ALL RIDERS OPERATING A MOTORCYCLE WILL BE REQUIRED TO WEAR A DOT CERTIFIEC HELMET IN ANY STATE WE CONDUCT A RIDE REGARDLESS IF THE LAW OF THAT STATE REQUIRES THE USE OF A HELMET OR NOT.
As a Rider you agree to abide by the directions and rules given by the organizers of The Edge and understand that the privilege to participate may be removed with or without refund if the you are found to be in violation of the rules set forth or acting/performing in an unsafe manner, or any manner disruptive to the operation of the event(s).
You agree and are aware of and voluntarily assume ALL THE RISKS ASSOCIATED WITH MOTORCYCLES and/or MOTOR VEHICLES, including the potential of SERIOUS INJURY AND/OR DEATH inherent with ownership and the operation of a motorcycle and/or motor vehicle. You acknowledge that riding a motorcycle and/or operating a motor vehicle is a dangerous and potentially hazardous activity which can be a test of a person’s physical and mental limits and carries with it the potential for death, serious injury and property loss. The risks include, but are not limited to, those caused by terrain, other facilities, temperature, weather, the condition of your equipment, vehicular traffic, actions of other people including, but not limited to organizers, participants, volunteers, spectators, agents, The Edge and its officers, directors and employees. These risks are not only inherent to the operator of the motorcycle and/or motor vehicle, but the risks are also present for passengers, spectators and volunteers. You hereby assume all of the risks of participating, viewing and/or volunteering in The Edge. You realize that liability may arise from negligence or carelessness on the part of the persons or entities organizing or conducting this event and you hereby agree to release them of all possible liability. You certify that you are at least 18 years old and promise not to sue and agree to pay all court costs and all attorney fees that result from your actions, civil or otherwise.
You certify that you are physically fit with no known physical or mental impairments. You acknowledge that this Rider Policy and Liability Release form will be used by The Edge, sponsors and organizers of the event(s), in which you may participate and that it will govern your actions and responsibilities at said events. You certify that you are not under the influence of any narcotic, alcohol or other drug that may impair your understanding or judgment and that you will not at any time during the event(s) operate your motorcycle or motor vehicle under the influence of any narcotic, alcohol or drug. It is your sole responsibility to and you certify that you have adequate insurance to cover all medical claims, the motorcycle, the motor vehicle, and any other equipment and any damage or liability you may ultimately be found responsible for, during your participation with The Edge.
The use of any form of alcohol or illegal drugs is strictly prohibited. If you are found to be under the influence of alcohol or illegal drugs then you will be prohibited from any further participation and they will forfeit the right to any refund.
No firearms or any other weapons will be allowed at any venue during the event. This includes small or large or fixed bladed knives, exposed pocket, clip-on, or folding knives, and firearms. Some or all venues prohibit all persons who enter the venue from carrying a handgun, firearm, or prohibited weapon of any kind on to the property regardless of whether the person is licensed to carry a handgun or not.
The Edge Tour Schedule and Ride Schedule is displayed on The Edge website and it outlines the complete day to day itinerary. It is the intent of the Edge Riders and Ground Crew to follow the ride route outlined in the Ride Schedule so that The Edge Tour stays on time and on schedule to meet all obligations and to proceed in a safe manner at all times. The Edge is not a race and will not be conducted like a race. Pre-determined schedule Pit Stops will take place along the ride route with a designated period of time to allow all Participants time to fuel their vehicles, grab a refreshment and rest. The Edge will adhere to the Federal, State and Local laws, rules and regulations of travel on the highways and roads of the United States.
It is dependent upon the total number or Riders who sign up to participate with The Edge as to how each day is managed. Granted that a Ride Schedule for each day has been determined there may reasons to alter the Ride Schedule based upon the number of Riders. Riders have the opportunity if they wish to travel independently or separately of The Edge Tour. Riders can at their own discretion create their own schedule and route with departure times, pit stops, rest stops, arrival times, etc.
With respect to inclement weather, The Edge may or may not commence or take place in inclement weather. If weather plays a role in delaying The Edge then provisions will be made in an attempt to keep The Edge on schedule. If The Edge at any time is forced to cancel then all Participants affected by the cancellation are entitled to a full refund of the cost of the Rider Package within 15 days of cancellation.
The Rider Experiences/Rider Packages are designed to be fully inclusive of costs including hotel accommodations, all food and beverage, rider merchandise, entertainment and any extras that are planned for the day. Each package outlines and lists in detail everything that is included in the package along with the price. Riders need to be aware and be prepared to pay for additional expenses that they may incur that are not included in the Rider Packages and these expenses are at the sole discretion of the Rider. An example of such expenses might include but not be limited to incremental lodging expenses such as for a room upgrade, room service, etc., food and beverages (other than what is included in the Rider Package), and gasoline, oil, repairs and maintenance and any other costs or expense (other than what is included in the Rider Package).
At any given time, The Edge may have to make changes to the Tour Schedule and Ride Schedule. If any changes are made then those changes will be posted to The Edge website. Efforts will be made to notify all Riders of any changes. We recommend that Riders log onto The Edge website (www.liveyourlifeontheedge.com) to check for any updates or schedule changes.
All Rider must operate their motorcycles and/or motor vehicle in a safe manner at all times. The sole and exclusive judgment of such fact will be determined by The Edge personnel. Any instructions given a Rider must be followed for the safety of all Riders. If such instructions are not followed then we reserve the right to terminate the Rider’s involvement for the remainder of the Ride or instruct the Rider that he or she must ride in the back of the pack and or be accompanied by an official member of The Edge Crew for the remainder of the Ride.
Operating a Motorcycle or Motor Vehicle is a dangerous activity and the risk of accidents or an injury could occur. In the event of an accident the Edge Personnel will evaluate the safest place to assess the status of the Rider and/or Rider(s) condition. It may be determined by Edge Personnel that other Riders not involved in the assessment of a Rider or Rider(s) condition, that ride will continue as planned. Should the assessment result in the Rider and/or Riders being unable to continue then all efforts will be made to accommodate the needs of the Rider to ensure their safety and as well as assisting to facilitate the transportation of their motorcycle or motor vehicle to a safe location.
The Edge is designed to be a fun and entertaining event. When The Edge completes a riding day the motorcycles and motor vehicles will be parked and it is understood and you agree that the riding activities for the day are completed. The Edge After Dark is designed to be a private social gathering complete with food and beverages, including alcoholic beverages, for everyone associated with The Edge. Alcohol is expected to be consumed responsibility. Should we feel that a Rider is not doing so then we reserve the right to take the necessary actions required to protect the Rider and any third parties of The Edge.
In the event of any dispute arises about a Rider’s participation in The Edge, all efforts will be made to remedy the dispute. If the dispute cannot be solved the Rider’s sole remedy against the Edge will be limited to a full refund of fees. As a condition of participation, all Riders agree to waive any other damages other than the refund of fees paid as set forth in this paragraph.
As a Rider you hereby state that for myself, heirs, executors, and administrators or anyone acting on my behalf, agree to assume all risks, waive all claims, release all liability, and indemnify and defend and hold SEI and their respective companies, subsidiaries, employees, independent contractors, affiliates, licensees or assigns including but not limited to other Event Sponsors and third parties associated to and with The Edge, harmless and you agree to indemnify and hold harmless and to voluntarily release, discharge, waive and relinquish any and all actions or causes of action against SEI and each of its related companies, successors, officers, agents, employees and licensees or the owners, officers, shareholders and employees of any of them and all entities associated with any of its productions or activities (collectively, “Company Indemnified Parties”, each individually a “Company Indemnified Party”) from any and all claims, demands, liabilities (including, but not limited to, personal injury, property damage, property loss, attorney fees and wrongful death) resulting in any manner from my involvement whether caused by negligence or otherwise unless the gross negligence or intentionally tortious conduct of the Company Indemnified Parties is the proximate cause of the harm suffered by you.
The Edge personnel reserve the right to instruct a Rider to comply with these policies as a condition of a Rider’s continued participation in The Edge and The Edge personnel in their sole and exclusive discretion can reject any Rider and to terminate any Rider’s involvement in The Edge at any time (whether before or after The Edge has begun) for any reason. It is at the discretion of Edge Personnel to issue a refund in full or of any portion of any fees in the event.
I EXPRESSLY WAIVE ANY BENEFITS I MAY HAVE UNDER SECTION 1542 OF THE CALIFORNIA CODE, or any other law, that provides that a general release does not extend to claims which I do not know of or suspect exist, which if known by me may have materially affected my decision to sign this agreement.
I understand that film, video and/or still photography will be taken of and I HEREBY GRANT to SEI and The Edge, and any third party acting with and under the authority granted by SEI, the unrestricted, perpetual, worldwide right and LICENSE TO USE MY NAME, PHOTOGRAPH, LIKENESS, VOICE AND BIOGRAPHICAL INFORMATION, and any photograph, video or audio tape that may be taken of me or that includes such materials without further compensation or notice to or permission from me or any third party.
THIS AGREEMENT SHALL BE GOVERNED BY NEVADA LAW, without regard to its choice of law rules. Any dispute or claim relating to this Agreement or the Event shall be finally resolved by BINDING ARBITRATION under the United States Arbitration Act in the state of Nevada.
I have reviewed and read this agreement carefully. I understand the rights I am waiving and my signature below indicates that I fully understand and agree to the contents of the Rider Policy and Liability Release.
BY COMPLETING THE PURCHASE OF A RIDER PACKAGE MEANS YOU AGREE TO THESE TERMS.
